By accessing or using the Website, you confirm that you are at least 18 years old, have the legal capacity to enter into binding agreements, and agree to be bound by these Terms. If you do not agree, do not use the Website.
These Terms apply exclusively to the Website. Use of the Q Kyun mobile application is governed by separate App Terms of Use.

The Website provides information about Q Kyun, a position-based queue orchestration platform designed for Indian service venues. The Website serves as an informational and marketing resource, allowing visitors to learn about the product, request demos, contact us, and access legal and policy documents. The Website does not provide queue management services directly; those are delivered through the mobile application.

THIS LIMITATION APPLIES REGARDLESS OF THE LEGAL THEORY (CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE) AND EVEN IF BEYOND QUANTUM TECHNOLOGIES HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATED TO THE WEBSITE SHALL NOT EXCEED INR 10,000 (INDIAN RUPEES TEN THOUSAND) OR THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, WHICHEVER IS GREATER.

We reserve the right to modify these Terms at any time. Changes will be effective upon posting on the Website with an updated Effective Date. Material changes will be highlighted via a prominent banner on the Website. Your continued use after modifications constitutes acceptance. We may terminate or suspend your access to the Website at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Website ceases immediately. We shall not be liable for any failure or delay in performance due to causes beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, pandemic, government actions, internet service disruptions, or power failures.
16. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of India, without regard to conflict of law principles.
16.2 Dispute Resolution
Any dispute arising out of or in connection with these Terms shall first be attempted to be resolved through good-faith negotiation for a period of 30 days. If negotiation fails, the dispute shall be referred to arbitration under the Arbitration and Conciliation Act, 1996. The arbitration shall be conducted in Lucknow, Uttar Pradesh, India, by a sole arbitrator mutually appointed. The language of arbitration shall be English. The arbitral award shall be final and binding.
16.3 Jurisdiction
Subject to the arbitration clause above, the courts of Lucknow, Uttar Pradesh, India shall have exclusive jurisdiction.
